Terms of Service

1. Acceptance of Terms
By accessing or using the Eventa Markets platform ("Platform"), operated by an individual as a non-profit oriented one-person organization ("Operator", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). The Platform software and related intellectual property are private property of the Operator. If you do not agree to these Terms, you must not access or use the Platform.
When you use Xumm, Xaman, or other third-party wallet or signing services, their terms and privacy policies apply to those services. We do not control those providers and do not receive your private keys.
Except where required by applicable law, you are not entitled to organizational or legal disclosures beyond what the law requires. Additional information and documentation may be provided on request where appropriate (including for partner or regulatory review).
We reserve the right to modify these Terms at any time. Material changes will be communicated via the Platform or email. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.
2. Eligibility
To use the Platform, you represent and warrant that:
- You are at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is greater.
- You are not located in, nor a citizen or resident of, any jurisdiction where the use of prediction markets or digital asset services is prohibited or restricted by applicable law.
- You are not on any government sanctions list, including but not limited to the OFAC Specially Designated Nationals list, the EU Consolidated Sanctions list, or the UN Security Council Sanctions list.
- You have the legal capacity to enter into a binding agreement.
- You will comply with all applicable local, national, and international laws and regulations.
3. Nature of the Platform
3.1 Prediction Market
The Platform operates as a prediction market where users trade outcome shares on real-world events. Share prices are determined by a transparent, formula-based Automated Market Maker (LMSR). The Operator does not act as a counterparty, bookmaker, or house. Prices are not set by discretion; they are derived from published mathematical formulas.
3.2 No Investment Advice
Nothing on the Platform constitutes financial, investment, legal, or tax advice. Share prices reflect collective market sentiment and should not be relied upon as predictions, recommendations, or guarantees of future outcomes. You acknowledge that trading on the Platform involves risk of loss, including the potential loss of your entire position.
3.3 Digital Assets & Payment Methods
The Platform is a prediction market where positions are denominated and settled in digital assets. You fund your account and receive payouts in digital assets. Fiat-to-digital asset conversion may be offered via integrated on-ramp solutions (e.g. WalletConnect on-ramp partners); such services are provided by third parties and subject to their terms. You are solely responsible for the security of your wallet credentials and private keys.
4. Account Registration & Security
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials, including passwords and wallet private keys.
- You agree to notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in suspicious activity.
- One account per person. Multiple accounts are prohibited and may result in account closure and forfeiture of balances.
5. KYC/AML Compliance
To comply with applicable anti-money laundering (AML) and know-your-customer (KYC) regulations, we may require you to provide identity verification documents. You agree to:
- Submit valid government-issued identification when requested.
- Provide proof of address and source of funds documentation as required for your KYC tier.
- Cooperate with additional verification requests as deemed necessary by the Operator.
Failure to complete required KYC verification may result in restricted access to Platform features, including trading and withdrawal capabilities. We reserve the right to refuse service to any user who fails to satisfy KYC/AML requirements.
6. Trading Rules
6.1 Share Purchases
When you purchase shares, you enter into a binding transaction at the price determined by the AMM at the time of execution. All trades are final once confirmed. The cost of shares, including applicable fees, is disclosed before you confirm a trade.
6.2 Market Resolution
Markets are resolved according to their stated resolution criteria and designated data sources. The resolution process is described in the Platform Documentation. The Operator's resolution decision is final, subject to the dispute resolution process described below.
6.3 Settlement
Upon resolution, winning positions are settled automatically. Payouts are calculated per the published formula (gross payout minus platform fee) and credited to your wallet. Losing positions receive zero payout.
6.4 Market Cancellation
The Operator reserves the right to cancel a market in exceptional circumstances, including but not limited to: ambiguous resolution criteria, data source unavailability, evidence of market manipulation, or regulatory requirement. In the event of cancellation, all positions are refunded at their original cost basis.
7. Fees
The Platform charges the following fees, which are disclosed before trade execution:
- Trading spread: A margin applied to AMM-derived prices (typically 1–3%).
- Trading fee: A per-trade commission added to the cost of shares (typically 50–200 basis points).
- Settlement fee: A fee deducted from gross payouts at settlement (0–200 basis points, configurable per market).
- Withdrawal fees: Network transaction fees applicable to digital asset withdrawals.
Fee parameters are set at market creation and cannot be changed retroactively for that market. Current fee schedules are available on the Platform.
8. Deposits & Withdrawals
- Deposits of digital assets are credited upon network confirmation according to the applicable network's requirements. Fiat on-ramp (e.g. via WalletConnect on-ramp solutions) may be available to acquire digital assets; third-party terms apply.
- Withdrawals are subject to KYC tier limits and may require administrative approval.
- You are responsible for ensuring that the destination address for withdrawals is correct. Digital asset transactions may be irreversible; errors in address or amount cannot be corrected after confirmation.
- The Operator is not liable for delays caused by network congestion, third-party payment or on-ramp providers, or force majeure events.
9. Prohibited Conduct
You agree not to:
- Use the Platform for money laundering, terrorist financing, or any other illegal activity.
- Manipulate markets through wash trading, spoofing, or coordinated activity with other users.
- Exploit bugs, vulnerabilities, or errors in the Platform software or AMM algorithm.
- Use automated scripts, bots, or other tools to gain an unfair advantage without prior authorization.
- Create multiple accounts or impersonate another person.
- Attempt to reverse-engineer, decompile, or disassemble the Platform software.
- Circumvent any access restrictions, security measures, or geographic restrictions.
- Use the Platform in any manner that could damage, disable, overburden, or impair the Platform's infrastructure.
Violation of this section may result in immediate account suspension, forfeiture of balances, and referral to law enforcement authorities.
10. Intellectual Property
All content, software, algorithms, designs, trademarks, and other intellectual property on the Platform are owned by or licensed to the Operator as private property. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purpose. You may not reproduce, distribute, modify, or create derivative works from any Platform content without prior written consent.
11. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE OPERATOR DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
The Operator does not guarantee the accuracy, completeness, or reliability of any market prices, probabilities, or information displayed on the Platform. Market prices reflect collective participant sentiment and are not representations of fact.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.
THE OPERATOR'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO THE OPERATOR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless the Operator, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third-party rights.
14. Dispute Resolution
14.1 Internal Resolution
If you have a dispute regarding market resolution, account activity, or Platform operations, you should first contact our support team. We aim to resolve disputes within 7 business days.
14.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction applicable to the Operator's residence and operations, without regard to conflict of law provisions.
14.3 Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms that cannot be resolved through internal resolution shall be settled by binding arbitration in accordance with the rules of the applicable arbitration body in the jurisdiction governing these Terms.
15. Risk Disclosure
Important Risk Warning
- Loss of capital: Trading on prediction markets involves the risk of losing your entire position. Only trade with funds you can afford to lose.
- Asset volatility: The value of digital assets may be volatile. Your wallet balance may fluctuate significantly.
- No guarantee of returns: Past performance of markets or positions does not guarantee future results.
- Regulatory risk: The regulatory status of prediction markets and digital assets may change. Such changes could affect your ability to use the Platform or access your funds.
- Technical risk: The Platform may experience downtime, bugs, or security incidents that could affect your positions or balances.
- Irreversibility: Digital asset transactions may be irreversible. Errors in withdrawal addresses or amounts cannot be corrected after confirmation.
16. Termination
We may suspend or terminate your account at any time, with or without cause, including but not limited to violation of these Terms, regulatory requirements, or suspicious activity. Upon termination:
- Open positions will be settled or cancelled as appropriate.
- Remaining wallet balances will be made available for withdrawal, subject to applicable KYC/AML requirements and regulatory holds.
- Provisions that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) shall survive.
17. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy and Platform Documentation, constitute the entire agreement between you and the Operator.
- Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: Failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
- Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms freely.
